Massachusetts’s Small Business Health Insurance Regulations
- Guaranteed issue and renewability is in effect; insurance carriers must offer employers of 1-50 workers the same health plans they offer other small businesses, and cannot cancel a plan due to the health status of a group member. Minimum contribution or enrollment clauses may be imposed.
- Insurance carriers cannot charge higher premiums due to health status, gender or claims experience. Premiums can vary with age, family size, occupation or location of those in the group.
- Self-employed workers with no employees can enroll in a group plan, however those who choose an individual policy can deduct a portion of their premium costs when they file federal income tax.
