Colorado’s Small Business Health Insurance Regulations

  • Insurers have to offer each employer of 2-50 employees the same health insurance plans that they offer to other small employers in the state. An eligible employee need only work 24 hours a week to qualify for coverage. Participation and contribution requirements must be met.

  • Insurance cannot be cancelled due to illness of one member of the group, as long as the small business meets a minimum participation percentage.

  • Small employers can be charged a higher premium for seriously ill employees and smokers enrolled in a group plan. Premiums can also vary based on age, family size and location of business.

  • Those who are self-employed can enroll in individual or group insurance, as long as their business income is sufficient to pay the health insurance premium, and the business owner regularly works 24 hours per week at the business site. They must purchase coverage during annual open enrollment periods or within 31 days of the formation of their business. Aside from these restrictions, small business owners are guaranteed coverage regardless of health status.

  • The self-employed who buy their own health insurance can deduct 100% of the cost of health insurance premiums on their federal taxes.
