Alabama's Small Business Health Insurance Regulations

  • For companies with 2-50 employees, health insurance carriers cannot deny coverage. For companies with more than three workers, they can, however, require that up to 75% of the employees be enrolled.

  • Small business health insurance cannot be canceled due to the illness of one member of the group. This provision applies to all sizes of companies, and includes the ability to renew a policy without prejudice.

  • Employers can be charged higher premiums due to the health of their employees; however, in small businesses of fewer than fifty employees there is a limit to how high the premiums can become. Those with more than fifty employees aren't afforded that same limitation.

  • For the self-employed, group coverage is unavailable; however, they can deduct one hundred percent of the premium costs as an expense at tax time.
